WHEREFORE , the petition is GRANTED . The Decision dated April 15, 2016 and the Resolution d ted December 9, 2016 of the Court of Appeals in CA G.R. CR No. 36556 are hereby REVERSED and SET ASIDE . Accordingly, petitioner Edwin Fuentes y Garcia @ "Kanyod" and Nicky Calotes y Valenzuela @ "Jojo" are ACQUITTED of the crime charged. The Director of the Bureau of Corrections is ordered to cause their immediate release, unless they are being lawfully held in custody for any other reason. SO ORDERED.
