WHEREFORE , the petition is GRANTED . The Resolutions dated December 17, 2018 and May 24, 2019 of the Court of Appeals in CA-G.R. SP No. 158535 are REVERSED and SET ASIDE . The Orders dated August 24, 2018 and August 29, 2018 and the Judgment dated September 6, 2018 are hereby ANNULLED and SET ASIDE . Accordingly, Criminal Case No. 2017-0053 is REMANDED to the Regional Trial Court of Naga City, Branch 24 for further proceedings as indicated in this Decision. SO ORDERED.
