WHEREFORE, premises considered, the appeal is GRANTED. The decision dated 08 October 2008 and order[sic] dated 18 December 2008 are REVERSED AND SET ASIDE. A new decision is rendered, thus: 1. DECLARING Primitivo Macalandia[sic] not a bona fide tenant of the subject land; and 2.
