Ruling

WHEREFORE , in consideration of the foregoing disquisitions, the appeal is DISMISSED . The Decision dated January 30, 2012 of the Court of Appeals in CA-G.R. CR-HC No. 04540 is hereby AFFIRMED WITH MODIFICATION in that accused-appellant Ryan Frias y Galang, is sentenced to suffer the penalty of reclusion perpetua , without eligibility for parole. The accused-appellant is likewise ordered to pay P30,000.00 as exemplary damages and to pay interest on all monetary award for damages at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully satisfied. SO ORDERED.
