Ruling

WHEREFORE, the appeal is DENIED. The Decision dated April 20, 2012 of the Court of Appeals in CA-G.R. CR-HC No. 04061 is AFFIRMED with the following MODIFICATIONS: ( a ) In Criminal Case No. Q-00-93225 for Simple Rape, accused-appellant Mauricio Hallartey Mendoza is sentenced to suffer the penalty of reclusion perpetua, and is ordered to pay AAA the amounts of P50,000.00 as civil indemnity, P50,000.00 as moral damages, and P30,000.00 as exemplary damages. ( b ) In Criminal Case No. Q-00-93226 for Rape by Sexual Assault, accused-appellant Mauricio Hallartey Mendoza is sentenced to suffer the indeterminate penalty of imprisonment for 4 years and 2 months of prision correccional , as minimum, to 10 years of prision mayor , as maximum, and is ordered to pay BBB the amounts of P30,000.00 as civil indemnity, P30,000.00 as moral damages, and P30,000.00 as exemplary damages. The amounts of damages awarded are subject to interest at the legal rate of 6% per annum, to be reckoned from the date of finality of this judgment until fully paid. SO ORDERED.
