WHEREFORE , the appeal is GRANTED . Accordingly, the appealed Decision, dated 3 July 2015, of the Court of Appeals in CA-G.R. CR HC No. 06125, which affirmed the Decision, dated 7 March 2013, of the Regional Trial Court, Branch 120, Caloocan City (RTC), in Criminal Case No. C-81497, is hereby REVERSED and SET ASIDE . Defendant-appellant Michael Cabuhay is hereby ACQUITTED for failure of the prosecution to prove his guilt beyond reasonable doubt. He is ordered immediately RELEASED from detention unless he is detained for another crime or lawful cause. SO ORDERED.
