Ruling

WHEREFORE, the judgment of the lower court convicting appellant JUDITO ALQUIZALAS Y ALQUILITA of the crime of rape and sentencing him to reclusion perpetua is AFFIRMED, with modification that appellant shall pay damages amounting to ONE HUNDRED THOUSAND (P100,000.00) PESOS, broken down as follows: (a) the amount of P50,000.00 awarded to Marissa Bayang by the trial court, which should be categorized as actual or compensatory damages, and (b) the additional amount of P50,000.00 as moral damages in accordance with prevailing jurisprudence, while the award of P25,000.00 as exemplary damages is deleted. Costs against appellant. SO ORDERED.
