WHEREFORE , the appeal is GRANTED . The assailed December 11, 1998 Order of the RTC is SET ASIDE and the case is consequently REMANDED to the RTC with the directive that all defendants-appellees be required to file their respective responsive pleading, and to thereafter proceed with the trial on the merits as well as the resolution of the case with dispatch. No costs. SO ORDERED.
