WHEREFORE, the petition for certiorari is GRANTED, and the challenged Decision of the Fifth Division of the National Labor Relations Commission promulgated on February 28, 1996 is NULLIFIED AND SET ASIDE. The Decision of the Executive Labor Arbiter, Cebu City, dated February 7, 1995 is REINSTATED and hereby AFFIRMED, with the sole modification that the complaint of DELFIN HINGPIT is dismissed, for lack of merit. No pronouncement as to costs. SO ORDERED.
