WHEREFORE , the Petition for Review on Certiorari is GRANTED . The assailed August 25, 2011 Decision and January 15, 2013 Resolution of the Court of Appeals in CA-G.R. SP No. 02687 are REVERSED and SET ASIDE . The case is REMANDED to Branch 12, Regional Trial Court, San Jose, Antique for it to settle in Civil Case No. 2005-4-3496 the matter of Marl Jhorylle Abella's purported paternal relation with respondent Policarpio Cabañero and, in the event of a favorable determination on this, to later rule on the matter of support. SO ORDERED.
