WHEREFORE , the foregoing premises considered, the Decision dated March 9, 2012 of the Court of Appeals in CA-G.R. CR-HC No. 04466 is REVERSED and SET ASIDE . For failure of the prosecution to prove his guilt beyond reasonable doubt, Joselito Beran y Zapanta is hereby ACQUITTED of the charge of violation of Section 5, Article II of Republic Act No. 9165. His immediate RELEASE from detention is hereby ORDERED , unless he is being held for another lawful cause. Let a copy of this Decision be furnished the Director of the Bureau of Corrections, Muntinlupa City for immediate implementation, who is then also directed to report to this Court the action he has taken within five (5) days from his receipt of this Decision. SO ORDERED.
