WHEREFORE , the appeal is GRANTED. The 31 January 2011 Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 03844 affirming the judgment of conviction dated 8 October 2008 of the Regional Trial Court, Branch 164 of Pasig City is hereby REVERSED and SET ASIDE . Accused-appellant RICHARD GUINTO y SAN ANDRES is hereby ACQUITTED and ordered immediately released from detention unless his continued confinement is warranted for some other cause or ground. SO ORDERED.
