WHEREFORE, the Court finds accused, Delano Mendiola, guilty beyond reasonable doubt of the crime charged in the Information, and considering that the victim, Daryll Mendiola, was then only five (5) years old and the daughter of the accused, he is hereby sentenced to suffer the supreme penalty of DEATH, and indemnify the victim the sum of P50,000.00, plus the costs of suit. SO ORDERED.
