Ruling

WHEREFORE, the appeal is DISMISSED. The Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 00563 dated 11 August 2006 insofar as it (a) modified the penalty of death to reclusion perpetua with all its accessory penalties, and (b) affirmed the award by the Regional Trial Court of Malolos, Bulacan, Branch 78 of P50,000.00 as civil indemnity and P50,000.00 as moral damages, each for every count of rape, is AFFIRMED. The award of P10,000.00 as exemplary damages for each of the three counts of rape is DELETED. Accordingly, appellant Arturo Domingo y Gatchalian is sentenced to suffer the penalty of reclusion perpetua with all its accessory penalties, to pay AAA (to be identified through the Informations) the sum of P50,000.00 as civil indemnity and P50,000.00 as moral damages, for each of the three (3) counts of rape, and to pay the costs. SO ORDERED.
