WHEREFORE, premises considered, the Court hereby finds the accused CARLITO TAYAO y LAYA "guilty" beyond reasonable doubt of the crime of Parricide as defined and penalized under Article 246 of the Revised Penal Code and hereby sentences him to suffer the penalty of reclusion perpetua, considering that the penalty of death can no longer be imposed, and to indemnify the victim's heirs the sum of P50,000.00. Costs against the accused. SO ORDERED.
