WHEREFORE, premises considered, court hereby finds the accused Elino "Bobong" Naguita guilty beyond reasonable doubt, as principal by direct participation, with the crime of Murder, qualified by treachery, defined and penalized under Article 248 of the Revised Penal Code, as amended by Section 6 of R.A.
WHEREFORE, premises considered, court hereby finds the accused Elino "Bobong" Naguita guilty beyond reasonable doubt, as principal by direct participation, with the crime of Murder, qualified by treachery, defined and penalized under Article 248 of the Revised Penal Code, as amended by Section 6 of R.A. 7659, as charged in the Information and considering the generic aggravating circumstance of evident premeditation in the commission of the offense without any aggravating circumstance to suffer the supreme penalty of death, with all the accessories of the law, to indemnify the heirs of the deceased victim Wenifredo Naguita the total sums of P74,500.00 as actual damages, P100,000.00 as moral damages, P50,000.00 as standard indemnity for death (pursuant to existing jurisprudence) and to pay cost of the proceeding. SO ORDERED.
