WHEREFORE, in view of the foregoing considerations, judgment is hereby rendered as follows: In Criminal Case No. R-3360, the court finds the accused, ROMEO HILLADO guilty beyond reasonable doubt of the crime of Murder and hereby sentences him to suffer an indeterminate penalty of TEN (10) YEARS and ONE (1) DAY of Prision Mayor as minimum to EIGHTEEN (18) YEARS, EIGHT (8) MONTHS and ONE (1) DAY of Reclusion Temporal as maximum, with accessories provided by law; and to indemnify the heirs of the deceased, Amor Baltazar, in the sum of FIFTY THOUSAND PESOS (P50,000.00) without subsidiary imprisonment in case of insolvency. In Criminal Case No. R-3361, the Court finds the accused, ROMEO HILLADO, guilty beyond reasonable doubt of the crime of Frustrated Murder and hereby sentences him to suffer an indeterminate penalty of TEN (10) YEARS and ONE (1) DAY of Prision Mayor as minimum to FOURTEEN (14) YEARS and EIGHT (8) MONTHS OF Reclusion Temporal as maximum, with accessories provided by law; and to indemnify the private offended party, Margarito Balestramon in the sum of NINETEEN THOUSAND FIVE HUNDRED PESOS ( P 19,500.00) without subsidiary imprisonment in case of insolvency. The accused shall, however, be entitled to the full term of his preventive imprisonment, provided, that he shall have agreed in writing to abide with the disciplinary rules and regulations imposed on convicted prisoners; otherwise, he shall be credited only (4/5) of his preventive imprisonment. With costs against the accused in both instances. SO ORDERED.
