WHEREFORE , the instant appeal is DISMISSED . The assailed Decision dated April 28, 2015 of the Court of Appeals in CA-G.R. CR-HC No. 06568, which affirmed in toto the Decision dated April 25, 2012 of the Regional Trial Court of Manila, Branch 53, in Criminal Case No. 03-216994 finding the accused-appellant Jose Cutara y Brix GUILTY of violation of Section 5, Article II of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, is AFFIRMED . SO ORDERED.
