WHEREFORE , the petition is hereby GRANTED . The assailed Decision dated May 29, 2009 and Resolution dated August 14, 2009 of public respondent National Labor Relations Commission are hereby SET ASIDE . Accordingly, the Decision dated February 28, 2006 of the Labor Arbiter is REINSTATED . SO ORDERED.
