WHEREFORE , the judgment of the court a quo finding accused FERNANDO RAMILLA Y RENTINO guilty of qualified rape, imposing upon him the supreme penalty of Death and ordering him to indemnify the offended party Crisanda Cabugza Calderon P100,000.00 and to pay the costs, is MODIFIED. Accused FERNANDO RAMILLA Y RENTINO is convicted of statutory rape only under Art. 335 of the Revised Penal Code and his DEATH sentence is reduced to RECLUSION PERPETUA .
