WHEREFORE, premises considered , judgment is hereby rendered in favor of the complainant declaring the Contract to Sell executed by the parties as having been Rescinded and ordering the Respondent to: Pay the complainant the amount of P727,921.82 as refund of the payments made; Pay the complainant 12% legal interest computed from the date of filing of this instant case until its final determination; Pay the complainant the amount of P50,000.

Of (sic) Presidential Decree No. 957. SO ORDERED.
