WHEREFORE, premises considered, judgment is hereby rendered ordering defendant [Verga] to: 1) RETURN the Php4,000,000.00 representing actual damages in favor of the Plaintiff [Harbor Star]; 2) PAY attorney's fees equivalent to 5% of the amount due; and 3) PAY legal interest at 12% from demand and cost of suit. Defendant's claim for actual, moral and exemplary damages, together with legal interest, attorney's fees and costs of suit are hereby DISMISSED for utter lack of merit. SO ORDERED.
