WHEREFORE , the Decision of January 19, 2009 of the Regional Trial Court of Quezon City, Branch 77 is hereby REVERSED and SET ASIDE . Said court is DIRECTED to immediately act on petitioner's petition in LRC Case No. Q-14305 (01) in accordance with the foregoing disquisitions. SO ORDERED.
