WHEREFORE, the Court finds the defendant as having a better right of possession over the subject parcels of land as against the plaintiff and hereby orders this case be dismissed. For lack of evidence to prove bad faith on the part of the plaintiff in the filing of this case; and in line with the Court's policy not to put penalty on the right to litigate, the counterclaim of the defendant is likewise dismissed. With no pronouncement as to costs. SO ORDERED.
