WHEREFORE , the petition is PARTLY GRANTED . The Decision dated June 30, 2011 of the Court of Appeals in CA-G.R. SP No. 110110 is REVERSED and SET ASIDE . The Resolution dated March 10, 2003 of the Provincial Prosecutor and the Resolution dated November 27, 2008 of the Department of Justice in I.S. No. 2002-414 are NULLIFIED insofar as respondents PO1 Leo T. Dangupon, 1 st Lt. Philip Fortuno, and Cpl. Edilberto Abordo are concerned. Accordingly, the Department of Justice is DIRECTED to issue the proper resolution in order to charge the above-mentioned respondents in accordance with this Decision. SO ORDERED.
