WHEREFORE , the appeal is DISMISSED . The Decision dated January 15, 2021, of the Court of Appeals in CA-G.R. CR-HC No. 13666 is AFFIRMED with MODIFICATION: 1. In Criminal Case No. 20724-D-PSG, accused-appellants Nhelmar Mendiola y Martin alias "Honda," Noel Mendiola y Ponce alias "Noel," and Glen Ramos y Akiatan alias "Glen," are found GUILTY beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165. Each of them is sentenced to suffer the penalty of Life Imprisonment and ordered to pay a fine of P1,000,000.00; and 2. In Criminal Case No. 20725-D-PSG, accused-appellant Noel Mendiola y Ponce alias "Noel" is found GUILTY beyond reasonable doubt of violation of Section 11, Article II of Republic Act No. 9165. He is sentenced to suffer the penalty of Life Imprisonment and to pay a fine of P1,000,000.00. SO ORDERED.
