Ruling

WHEREFORE, the Court finds the accused Restituto Cabacan y Mendoza GUILTY beyond reasonable doubt of the crime of murder as defined and penalized under Article 248 of the Revised Penal Code, as amended, and there being no aggravating circumstance or in mitigation thereof, he is hereby sentenced to suffer the penalty of reclusion perpetua, with the accessory penalty of the law, and to pay the heirs of Nestor Vibas the amount of P50,000.00 as death indemnity; the sum of P25,000.00 as actual damages and to pay the costs. SO ORDERED.
