Ruling

WHEREFORE, this Court finds the accused GUILTY beyond reasonable doubt of five (5) counts of rape under Article 335 of the Revised Penal Code in Criminal Cases Nos. 1541-M-98, 1543-M-98, 1544-M-98, 1545-M-98 and hereby sentences him to suffer the penalty of Reclusion Perpetua . In Criminal Case No. 1542-M-98, this Court finds the accused GUILTY of Incestuous Rape under Article 266-A and B of the Revised Penal Code considering that the crime was committed after October 22, 1997, the effectivity date of Republic Act No. 8353 and hereby sentences him to suffer the supreme penalty of DEATH. In Crim. Case No. 1547-M-98 as pointed out above, the accused, for lack of evidence is hereby ACQUITTED of the offense charged. Further, the accused is hereby ordered to pay the victim the amount of Five Hundred Thousand Pesos (P500,000.00) as civil liability and moral damages. SO ORDERED.
