WHEREFORE, the petition is DENIED . The assailed Decision of the Court of Appeals dated 27 February 1998 which set aside the orders dated 26 December 1996 and 7 March 1998 of the Regional Trial Court of Manila, Br. 46, and ordered the dismissal of Civil Case No. 96-80021 is AFFIRMED , there being no reversible error on the part of the appellate court.
