Ruling

WHEREFORE, viewed in the light of the foregoing facts and circumstances, reconstitution is hereby granted. The Register of Deeds of Lapu-Lapu City is hereby directed to reconstitute the original certificate of title of Lots Nos. 4749, 4765, and 4777, of Opon Cadastre, upon payment of the corresponding fees in the name of the decreed owners, namely: Eduardo Booc, Mercedes Booc, Aurelia Booc, Pedro Booc, Florentino Booc and Feliciana Booc based on the Index of Decrees, sketch plans, technical descriptions and Report of the Land Registration Authority, subject to the following conditions: 1. A first lien in favor of the National Government to guarantee the payment of the special taxes assessed pursuant to Section 18 of Act 2259, as amended; and, 2. A lien in favor of E. Bunagan Surveying Co. to guarantee the payment of the costs of cadastral survey and monumenting pursuant to Act 3327, as amended, unless the same has previously been cancelled; and provided further, that no certificate of title covering the same parcel of land exists in the office of the Register of Deeds concerned. The Register of Deeds of Lapu-lapu City is hereby directed to deliver the title thereof to the decreed owners or their successors-in-interest. SO ORDERED.
