WHEREFORE, in view of the foregoing, the Court finds accused Alberto Malacura y Maligro guilty beyond reasonable doubt of the crime of Rape and sentences him to suffer the penalty of reclusion perpetua which is twenty (20) years and one (1) day to forty (40) years and to pay Mary Rose Alonzo the amount of P50,000.00 as moral damages, P25,000.00 as exemplary damages and cost of the suit. SO ORDERED.
