Ruling

WHEREFORE, in view of the foregoing, accused JONEL F. GEPITULAN is found GUILTY of violating Sec. 16, Article II of Republic Act No. 9165. He is hereby sentenced by this court to suffer the penalty of Life Imprisonment and fine in the amount of Five Hundred Thousand (P500,000.00) Pesos. The marijuana subject matter of this case is hereby ordered confiscated and forfeited in favor of the State to be disposed of in accordance with existing rules and regulation. In the service of his sentence, accused is entitled to the full time he has undergone preventive imprisonment, if any, pursuant to Article 29 of the Revised Penal Code. Accused shall serve his sentence at Davao Prison and Penal Farm, B.E. Dujali, Davao del Norte. SO ORDERED.
