Ruling

WHEREFORE , the Decision dated November 29, 2018 and Resolution dated January 2, 2020 of the Court of Appeals in CA-G.R. SP No. 144469 are AFFIRMED with MODIFICATION . Petitioner Danilo A. David is ordered to PAY respondent Bank of the Philippine Islands the following amounts: 1. Ninety-Eight Thousand Five Hundred Twenty-Seven Pesos and 40/100 (P98,527.40) representing the principal obligation plus twelve percent (12%) interest per annum from September 2008 until June 30, 2013, and six percent (6%) interest per annum from July 1, 2013 until finality of this Decision. The total amount due shall in turn earn six percent (6%) interest per annum from finality of this Decision until fully paid; and 2. Ten percent (10%) of the total monetary award as attorney's fees . SO ORDERED.
