WHEREFORE, the decision of the Regional Trial Court of Tagbilaran City, Branch 1, in Criminal Cases Nos. 7887 and 7888, finding appellant Arturo Enad guilty of murder and frustrated murder is hereby REVERSED and SET ASIDE for insufficiency of the evidence to convict him beyond reasonable doubt. Appellant is ACQUITTED and ordered RELEASED from confinement immediately unless he is held for another lawful cause. SO ORDERED.
