WHEREFORE, the Court finds respondent Jesus T. Franco, Sheriff IV, assigned at the RTC, Branch 215, Quezon City, guilty of simple misconduct and is SUSPENDED from the service for two (2) months without pay and other fringe benefits including leave credits, [8] with a stern warning that a repetition of the same offense shall be dealt with more severely. SO ORDERED.
