WHEREFORE, the foregoing considered, this Court finds accused JESUS DUMAGAY y SUACITO GUILTY beyond reasonable doubt of the crime of "VIOLATION OF SECTION 5, ARTICLE II OF R.A. 9165["] and hereby sentences him to suffer a penalty of LIFE IMPRISONMENT and a fine of FIVE HUNDRED THOUSAND PESOS (Php 500,000) without subsidiary imprisonment. The dangerous drug subject of this case is ordered confiscated for proper disposal.
