WHEREFORE, the Court finds accused Arsenio Cortez y Macalindong a.k.a. "Archie" GUILTY beyond reasonable doubt of the crime of selling shabu penalized under Section 5, Article II of R.
WHEREFORE, the Court finds accused Arsenio Cortez y Macalindong a.k.a. "Archie" GUILTY beyond reasonable doubt of the crime of selling shabu penalized under Section 5, Article II of R.A. 9165 and hereby imposes upon him the penalty of life imprisonment and fine of Five Hundred Thousand (P500,000.00) Pesos with all the accessory penalties under the law. The plastic sachet containing shabu or methamphetamine hydrochloride (Exhibit "E-1") is hereby ordered confiscated in favor of the government and turned over to the Philippine Drug Enforcement Agency for destruction. SO ORDERED.
