WHEREFORE, judgment is hereby rendered finding the accused guilty beyond reasonable doubt of Murder with the use of unlicensed firearm and the court imposes upon him the penalty of DEATH and to pay the heirs of the victim the following without the benefit of subsidiary imprisonment: P50,000 by way of civil indemnity; P50,000 as moral damages; P22,660 as actual expenses with receipts; P30,000 in the discretion of the Court for expenses of the wake; and P40,000 in the discretion of the Court for the hospital bills; and P1,234,240 the amount of death indemnity for the forced heirs; With costs. The firearm used in the commission of the offense is hereby confiscated in favor of the government. Let the weapon be forwarded to the Firearms and Explosive[s] Unit, Camp Crame, Quezon City, through the Provincial Command, PNP, Lingayen, Pangasinan duly receipted. SO ORDERED.
