WHEREFORE, in light of the foregoing, the court finds the accused, ROMEL MARTIN y PE[Ñ]A, GUILTY beyond reasonable doubt of the crime of VIOLATION OF SECTION 5, ARTICLE II OF REPUBLIC ACT NO. 9165 , in Criminal Case No. 11-08-5719. Hence, the accused is sentenced to LIFE IMPRISONMENT and to pay a FINE OF FIVE HUNDRED THOUSAND PESOS (PhP500,000.00). Further, let the shabu marked as Exhibit "J", with submarkings, subject of this case be immediately transmitted to the Philippine Drug Enforcement Agency (PDEA) for the latter's appropriate disposition. No pronouncement as to the costs. SO ORDERED.
