WHEREFORE, after duly considering all the foregoing, the Court finds the accused Vicente Publico y Amodia GUILTY beyond reasonable doubt of the crime of Rape as charged in Criminal Case No. 5522-0 and of the crime of Attempted Rape as charged in Criminal Case No. 5521-0, and accordingly hereby sentences the said accused under Criminal Case No. 5522-0 to the supreme penalty of Death, whereas under Criminal Case No.

WHEREFORE, after duly considering all the foregoing, the Court finds the accused Vicente Publico y Amodia GUILTY beyond reasonable doubt of the crime of Rape as charged in Criminal Case No. 5522-0 and of the crime of Attempted Rape as charged in Criminal Case No. 5521-0, and accordingly hereby sentences the said accused under Criminal Case No. 5522-0 to the supreme penalty of Death, whereas under Criminal Case No. 5521-0, the Court penalizes the accused to an indeterminate sentence of 6 years and 1 day prision mayor as minimum to 12 years and 1 day reclusion temporal as maximum, and in both cases to pay the offended party as follows: P50,000.00 as indemnity and P50,000.00 as moral damages, in Criminal Case No. 5522-0; P50,000.00 as moral damages in Criminal Case No. 5521-0. For Criminal Case No. 5521-0, if the accused is a detainee, the period of his detention shall be credited to him in full if he abides in writing by the terms for convicted prisoners, otherwise, for only 4/5 thereof.
