WHEREFORE, premises considered, this Court finds accused MARK IAN LIBUNAO y MARIANO guilty beyond reasonable doubt of the offense of Homicide and hereby sentences him to suffer the indeterminate prison term of seven (7) years of prision mayor in its minimum period, as minimum, to fifteen (15) years of reclusion temporal in its medium period, as maximum. Likewise, said accused is hereby ordered to pay the heirs of the deceased, the following: The amount of Php71,000[.
WHEREFORE, premises considered, this Court finds accused MARK IAN LIBUNAO y MARIANO guilty beyond reasonable doubt of the offense of Homicide and hereby sentences him to suffer the indeterminate prison term of seven (7) years of prision mayor in its minimum period, as minimum, to fifteen (15) years of reclusion temporal in its medium period, as maximum. Likewise, said accused is hereby ordered to pay the heirs of the deceased, the following: The amount of Php71,000[.00] as actual damages; The amount of Php50,000[.00] as civil indemnity; The amount of Php50,000[.00] as moral damages; and P2,093,784.84 as reparation for the loss of earning capacity. Accused is also ordered to pay interest at the rate of six percent (6%) per annum from the time of the finality of this decision until fully paid, to be imposed on the aforementioned damages. No pronouncement as to costs. SO ORDERED.
