WHEREFORE, the decision of the Regional Trial Court of Tandag, Surigao del Sur, Branch 27, dated November 20, 2002, in Criminal Case No. 4306, is REVERSED and SET ASIDE and appellant Esmer Montenegro is hereby ACQUITTED. The National Bureau of Investigation is DIRECTED to assist in the arrest of the other accused in this case who are at large, for them to undergo arraignment and trial. Let a copy of this Decision be furnished its Director.
