Wherefore, finding defendant-contractor’s evidence more preponderant than that of the plaintiff, judgment is hereby rendered in favor of the defendant-contractor against the plaintiff and hereby orders: (1) that the instant case be DISMISSED; (2) that plaintiff pays defendant the amount of P4,000,000.00; for moral and exemplary & other damages; (3) P100,000.00 for attorney’s fees and cost of suit. SO ORDERED.
