WHEREFORE , foregoing considered, complainant is hereby found illegally dismissed. Respondents Helenar Construction and Joel Argarin, being the real employers of complainant, are ordered to pay the sum of Php177,294.40 representing his separation pay with backwages, service incentive leave pay and 13 th month pay. All other claims are dismissed for lack of basis.
