WHEREFORE , the decision of the Regional Trial Court of Pasay City, Branch 109 in Criminal Case No. 99-0295 is REVERSED and SET ASIDE . Appellant FRANCIS GAVINA Y QUEBEC is ACQUITTED of rape on the ground of reasonable doubt. He is ordered RELEASED forthwith from confinement, unless held for another valid cause. The Director of the Bureau of Corrections is further ordered to report to this Court, within five days from notice, compliance with this decision. SO ORDERED.
