WHEREFORE, the assailed decision of the National Labor Relations Commission in NLRC NCR Case. CA No. 00-2970-93 is SET ASIDE, and the decision of the Labor Arbiter in NLRC NCR Case No. 03-01576-91 is REINSTATED, subject to the modification that such amounts as the petitioner may have earned from employment elsewhere from the date of his illegal termination from his employment up to the date of his reinstatement should be deducted from the award of back wages and other benefits.
