WHEREFORE , the assailed Decision and Resolution of the Court of Appeals in CA-G.R. SP Nos. 03832-MIN and 03841-MIN are hereby REVERSED and SET ASIDE , and a new one ENTERED ordering petitioners to jointly and severally pay respondent the death benefits of Efren B.

WHEREFORE , the assailed Decision and Resolution of the Court of Appeals in CA-G.R. SP Nos. 03832-MIN and 03841-MIN are hereby REVERSED and SET ASIDE , and a new one ENTERED ordering petitioners to jointly and severally pay respondent the death benefits of Efren B. Malicse amounting to USD 40,000.00 or its peso equivalent at the time of payment, which shall earn legal interest at the rate of six percent (6%) per annum from the finality of this Decision until fully paid. SO ORDERED.
