The Decision and the Resolution of the Court of Appeals dated 30 October 2001 and 6 February 2002, respectively, are REVERSED AND SET ASIDE. The Resolution dated 26 June 2000 of the lower court is REINSTATED. The case is ordered REMANDED to the lower court for further proceedings.
