Ruling

WHEREFORE, the Court finds the accused Noel Sapinoso y Aguila, David Recreo y Sapinoso and Domingo Quila y Ringca all GUILTY beyond peradventure of doubt of the crime of RAPE defined and penalized under Article 335 of the Revised Penal Code, as amended by Section 11 of R.A. 7659, and hereby sentences accused Noel Sapinoso and David Recreo, except Domingo Quila, to three (3) DEATH penalties to be executed at the date to be set and in the manner provided for by law; each of all the accused to indemnify the offended party Yolanda Partida in the amount of P50,000.00; for them to suffer all the accessory penalties provided for by law; and to pay the costs. On the ground that accused Domingo Quila is a minor and appreciating in his favor such mitigating circumstance, he is hereby sentenced to suffer three (3) penalties of imprisonment ranging from Six (6) Years and One (1) Day of prision mayor, as minimum, to Fourteen (14) Years and Eight (8) Months and One (1) Day of reclusion temporal, as maximum. SO ORDERED.
