WHEREFORE, premises all considered, the Court finds accused Leoncio Aliviano GUILTY beyond reasonable doubt of the crime of RAPE as defined and penalized by Article 335 of the Revised Penal Code in relation to R.A. 7610 and R.A. 7659 and he is hereby sentenced to suffer the penalty of reclusion perpetua with accessory penalties provided for by law and to pay the victim Ivy Maquiling the sum of P50,000.00 as moral damages and to pay the costs of this suit. SO ORDERED.
